RESOLUTION NO. 2010-___-___

 

A RESOLUTION REGARDING THE REGULATION OF POLITICAL SIGNS

 

            WHEREAS, the Shorewood Forest Property Owners Association, Inc., is an Indiana  not-for-profit corporation; and

            WHEREAS, said Shorewood Forest Property Owners Association, Inc., is governed by its Board of Directors; and

            WHEREAS the Restrictive Covenants of Shorewood Forest Property Owners Association, Inc., prohibits the unauthorized display of signs on numbered lots within the development; and

            WHEREAS, the Indiana legislature has adopted Public Law 5-2010 which prohibits homeowners’ associations from adopting or enforcing any rule that prohibits any member of the homeowners’ association from displaying a political sign on the members’ property during the period beginning thirty (30) days before and ending five (5) days afer the date of the election to which the sign relates; and

            WHEREAS, the Board desires to adopt rules and regulations in compliance with said law;

            NOW THEREFORE, the Shorewood Forest Property Owners Association, Inc., acting by its Board of Directors, hereby adopts the following rules and regulations concerning the display of political signs:

                        1.         Political signs may only be displayed by the owner(s) of a numbered lot on said lot during the period between thirty (30) days before and five (5) days after the date of the election to which the signs relate.

                        2.         The size of the signs may not exceed two (2) feet by three (3) feet.  

                        3.         No more than two (2) signs may be displayed on any numbered lot pursuant to this resolution.

                        4.         The Shorewood Forest Property Owners Association, Inc., reserves the right to remove any signs that violate the rules contained in this resolution.

                        5.         As used in this resolution, “sign” refers only to a sign advocating:

                                                A.        The election or defeat of one (1) or more candidates for:

                                                  a)         nomination; or

                                                   b)         election;

                                    to a public office;

                                                B          support for or opposition to:

            a)         a political party; or

                                                 b)         a political party’s candidates; or

                                                C.        the approval or disapproval of a public question.

6.         The penalty for violation of this resolution shall be as the Board may provide from

                         time to time in its statement of fees and charges.
