GENERAL REGULATIONS
2.
IMPLIED CONSENT
A person who registers or operates a watercraft in waters over which
S.F.P.O.A. has jurisdiction implicitly consents to abide by those rules and
regulations set forth in this act.
3.
ENFORCEMENT
All peace officers of this State acting as agents of S.F.P.O.A. shall have the power and it shall be their duty to enforce the provisions of this act and all lawful rules and regulations.
4.
VIOLATIONS
Violations of these rules and regulations will result in a fine being
imposed upon the property owner(s) involved.
In such cases that family members or guests members or guests violate
these rules and regulations, it shall be the responsibility of the registered
owner of the watercraft involved to pay such fines.
If a violation occurs with more than one property owner in the same
watercraft, it shall be the responsibility of the watercraft operator involved
to pay such fines if the watercraft operator is a member of the S.F.P.O.A., if
not, then it shall be the responsibility of the registered owner of the
watercraft to pay such fines.
Nothing herein contained shall be construed to prohibit the S.F.P.O.A. or
its agents from appropriate charges in the Courts of Porter County in addition
to any fines herein provided for.
5.
DEFINITIONS
“Watercraft”
means any instrumentality or device in or by means of which a person may be
transported upon public or private waters of this State, and it includes every
motorboat, personal watercraft, sailboat, rowboat, skiff, dinghy, or canoe of
whatever length or size.
“Motorboat”
means a watercraft propelled by an internal combustion, steam, or electrical
inboard or outboard motor or engine or by any mechanical means. Sailboats that
are equipped with any such motor or engine when the same is in operation,
whether or not the sails are hoisted shall be considered a sailboat.
“Personal
Watercraft” shall mean a vessel, less than 16 feet, propelled by machinery,
which is designed to be operated by a person sitting, standing, or kneeling on
rather than being operated by a person sitting or standing inside the vessel.
“Boat”
means watercraft.
“Lake”
shall mean any and every body of water connected or a part of
“Person”
means natural person, firm, partnership, association, or corporation.
“Owner”
means a person who has legal title to a watercraft.
“To
Operate” means the act of navigating, driving, steering, sailing, rowing,
paddling, or otherwise moving or exercising physical control over the movement
of the watercraft.
“Visible”
means capable of being seen, by a person of normal vision on a dark and clear
night.
“Sewage”
means human body wastes.
“Litter”
means bottles, glass, crockery, cans, scrap metal, junk, paper garbage, rubbish,
plastic,or similar refuse.
“Wake
or
“Idle
Speed” means the slowest possible speed, not exceeding five (5) miles per
hour, so as to maintain steerage whereby the wake or wash created by the
watercraft is minimal.
“Trespassing”
means entering upon property of another without consent.
“Resident”
means the members and associate members of the corporation (any person who both
belongs to the family of a member or associate member and has the same residence
as the member to whose family he belongs).
6.
SAFETY VIOLATIONS
Violation
of this act is a Class C misdemeanor.
A
person who violated this act commits a Class D felony if:
(a)
he/she
has a previous conviction under this act; or
(b)
the
offense results in serious bodily injury to another person.
A
person who violates this act commits a Class C felony if:
(a)
the
offense results in the death of another person.
Definition
of Influence can mean but is not limited to:
(a)
alcohol
(b)
controlled
substance
(c)
any drug
other than alcohol, or a controlled substance
(d)
any
combination of alcohol, controlled substances, or other drugs; such that there
is an impaired condition of thought and action and the loss of normal control of
the person’s faculties to such an extent to endanger any person.
A person who operates a watercraft on the waters of
implicitly
consents to submit to the chemical test provisions of this act as a condition of
operating the watercraft. If a
person refuses to submit to a chemical test under this act, the S.F.P.O.A. shall
order the person off
“Chemical Test” means an
analysis of a person’s blood, breath, urine, or other bodily substance for the
determination of the presence of alcohol or a controlled substance.
If the chemical test results in evidence that the person is under the
influence, he/she at the discretion of the officer or the acting agents of the
S.F.P.O.A. may be arrested and charges filed in Porter County Superior Courts.
“Public Intoxication” It is unlawful for a person to be found in a
public place or a place of public resort, in a state of intoxication.
A person who violates a provision of this section is guilty of a Class B
misdemeanor.
“Minor’s Illegal Possession” It is unlawful for
a minor to possess an alcoholic beverage, to consume it, or to transport it.
A person who violates a provision of this section is guilty of a Class C
misdemeanor.
“Operation in Manner Endangering Others” No
person shall operate any boat in such a manner as to:
(1)
unnecessarily
endanger the person or property of another person;
(2)
unnecessarily
interfere with the safe and lawful use of the lake by another person;
(3)
unnecessarily
interfere with or obstruct a special event sanctioned or otherwise legally
permitted.
“Unlawful Operation/Speed, Manner” It shall be
unlawful for any person to operate any watercraft upon Lake Louise in any manner
or under any circumstances or at any rate of speed prohibited by these
regulations, or for any person operating any boat upon Lake Louise to fail to
operate the same in any manner required by these regulations.
“Prudent (Reckless) Operation” Every person operating any boat shall
operate the same in a careful and prudent manner, having due regard for the
rights, safety, and property or other persons, the conditions and hazards,
actual and potential, then existing, including weather and density of traffic,
and possible injury to the person or property of other persons.
“Speed” No person shall operate any boat at a rate of speed greater
than is reasonable and prudent, having due regard for the conditions and
hazards, actual and potential, then existing, including weather and density of
traffic, or greater than will permit him in the exercise of reasonable care, to
bring such boat to stop within the assured clear distance ahead.
Maximum speed limit is forty (40) miles per hour between
“Speed/Night” Between sunset and
“Life Preservers” The S.F.P.O.A. has adopted the new State of
“Night Operations/Lights” It shall be unlawful to operate any
watercraft upon Lake Louise during the period between sunset and sunrise which
is not equipped with a light or lights as hereinafter required, all in good
repair and operating condition and all displayed and lighted or burning except
as hereinafter otherwise permitted.
“Motorboats and Auxiliary Sailboats/White Light Aft” All motorboats
and auxiliary sailboats shall be equipped with one (1) or more white lights aft,
visible at all times casting a combined light three hundred and sixty (360)
degrees for a distance of two (2) miles or more.
“Motorboats and Auxiliary Sailboats/Starboard and Port Lights” All
motorboats and auxiliary sailboats equipped with a motor or engine at fifteen
(15) horsepower or more shall be equipped with a combination light forward,
lower than the white light aft, showing green to starboard and red to port,
visible for a distance of one (1) mile or more.
All lights shall be displayed at all times between sunset
and sunrise; however, the aft lights only may be displayed if said watercraft is
not under power.
“All Other Watercraft” All non-motorized boats (including canoes and
kayaks), all sailboats under sail alone, all boats not specifically mentioned in
this section and the preceding two (2) sections shall be equipped with a
portable hand lantern or flashlight, not affixed or attached to any part of the
boat, and capable of throwing a white light visible for a distance of two (2)
miles or more, and it shall be the duty of the operator of any such boat to
display the white light at all times between sunset and sunrise.
“Fire Extinguisher” All Motorboats shall be equipped with at least
one (1) operable extinguisher that is U.S.C.G. approved.
“Age of Operators-Motorboats” It shall be unlawful for any person
under the age of sixteen (16) years of age, and who does not possess a valid
State driver’s license to operate a watercraft with a horsepower rating in
excess of ten (10) horsepower except under the following condition:
(a)
Such
person under the age of sixteen (16) years, possesses a valid State probationary
driver’s license and is accompanied by a person who possesses a valid State
driver’s license and has attained the age of 18 years or older.
“Age of Operators-Personal Watercraft” It shall
be unlawful for any
person
under the age of eighteen (18) years, and who does not possess a valid State
driver’s license to operate a personal watercraft on
“Jurisdiction for Prosecution-persons between ages of 16 and 18 years
old” Any person between the ages of sixteen (16) and eighteen (18) who
violates any of the provisions of this chapter may be prosecuted and tried in
any court having jurisdiction over adult.
“Load beyond safe carrying capacity” No person shall operate any
boat, which is loaded with passengers or cargo beyond its safe carrying
capacity. The capacity of the
watercraft will be based on the U.S.C.G. carrying capacity plate when available
or in regard for the type, construction, and condition or state or repair of
said watercraft when U.S.C.G. carrying capacity plate is not available.
7.
OPERATION OF WATERCRAFT
“Guest Rule” All operators of watercraft, not a
member of the immediate family of a property owner, must be accompanied by the property owner, or a member of his
family
“Permitting Unlawful Operation” No person who is the owner of any
boat or who is in possession of any boat or who is entitled to the possession of
any boat shall authorize or knowingly permit any person to operate said boat
upon the waters of
“Hazardous Wake or
Every person operating any boat shall observe the following traffic rules
and regulations when applicable:
(a)
When two
boats are approaching each other “head to head” or nearly so, each boat
shall bear to the right (starboard) and pass the other boat on its left (port)
side.
(b)
When two
(2) motorboats are approaching each other obliquely or at right angles, the
motorboat on the right (starboard) shall have the right-of-way.
(c)
A boat
may overtake and pass another boat on either side if the same can be done with
safety and within the assured clear distance ahead, but the boat overtaken shall
have the right-of-way regardless of speed or direction of travel.
(d)
All
motorboats shall at all times give the right-of-way to all other non-motorized
watercraft regardless of speed or direction of travel.
(e)
A
motorboat leaving a dock, pier or shore shall yield the right-of-way to all
motorboats approaching the same.
(f)
A
motorboat entering the ski-area shall yield the right-of-way to all approaching
motorboats.
The S.F.P.O.A. Board of Directors will establish
“No Wake” or “Idle Speed” areas for safety purposes and to help reduce
erosion. The lake will be designated
“Idle Speed” only after sunset to
No person shall operate any boat in a circular course around any other
boat, any occupant of which is engaged in fishing, or around which a person or
persons are swimming.
No person shall anchor a motorboat, or have any non-motorized watercraft
in the designated ski area between the hours of 8:00 A.M. to sunset.
No boat shall be allowed to float free in the ski area unless preparing
for skiing or other related activities. No person may fish in the ski area and
surrounding safety zone from a watercraft during the times from 8:00 AM to
sunset from Memorial Day weekend through Labor Day.
No person operating or occupying any boat shall sound any whistle or horn
when the passage of such boat is clear and without danger or when a warning
signal is not necessary to prevent injury to person or property.
Unnecessary sounding of a whistle or horn is hereby declared to be a
public nuisance and is hereby prohibited.
No person operating any motorboat
shall permit any occupant to sit, stand, or lie on the gunwales, bow decking, or
transom while under power.
No person shall participate or compete in any boat race unless such race
is over a fixed and marked course and unless the S.F.P.O.A. Board of Directors
has duly issued a permit for such race.
No person shall attach any boat to any buoy or markers on
No person shall moor any boat to anything other than approved docks or
against the bank of the property owner’s residence.
Ring buoy-type offshore mooring is prohibited.
No person shall operate a watercraft within thirty (30) feet of the
shoreline or within thirty (30) feet of a dock at a speed greater than “Idle
Speed” only.
No person shall operate a watercraft within one hundred (100) feet
of the swimming zone or docking areas at a speed greater than “Idle Speed”
only.
No swimming or floating on flotation devices will be permitted in the designated ski area.
No scuba diving will be permitted in the designated ski area without
first securing a permit from the S.F.P.O.A. Board of Directors and having the
proper visual flagging while diving.
All provisions of these regulations with respect to the operation of
watercraft shall apply whether or not such watercraft is towing any person or
article.
No person shall operate any motorboat towing any water skier, water sled,
aquaplane, or similar object, or any person thereon, unless said motorboat is
occupied by at least one person who is giving his entire attention to watching
the object or person towed, and unless the person operating said boat is giving
his entire attention to the operation of said boat. The minimum age of Spotters
will be set at 6 years of age.
Regardless of the capacity of the inflatable device, no person shall
operate any motorboat towing any inflatable with more than one occupant at a
time in the ski area.
Every person operating any boat in the designated ski/caution area shall
operate it in a counter-clockwise direction.
No person shall jump or dive from the bridge.
No person shall operate any motorboat towing a water skier, or person on
an aquaplane, tube, or similar object after sunset to
No person shall operate any motorboat in the ski area that is towing a
device that is occupied by more than one person.
No skier is permitted to start from a dock, pier, or roped swimming area.
If a skier falls, he/she shall retrieve skis and raise one of the same
high, so as to be more visible to other watercraft.
All watercraft shall stay at least one hundred (100) feet from any
person in the water.
When a skier or tuber, etc. has fallen, boat operator is to throttle back
and return to skier as soon as
possible, never enlarging the distance between boat and skier.
The observer is to raise an orange flag large enough to be visible 200
feet and high enough to be seen 360 degrees over any portion of the boat when
the skier or tuber, etc. has fallen. The
observer will continue to raise the flag until the skier or tuber, etc. has
resumed skiing/tubing or upon boarding the boat and is out of the water.
Tow ropes shall be pulled in immediately after use, and watercraft shall
not operate in any portion of
No watercraft shall travel directly behind another watercraft towing a
skier, tuber, or passenger on any similar devices at a distance closer than two
hundred (200) feet.
Tandem devices or devices with more than one occupant may be towed at idle
speed only in the idle speed areas of the lake at any time between the hours
of
No tandem skiing, tandem tubing, tandem knee boarding, etc. in the ski
area on Saturday, Sunday, and Holidays between the hours of 12:00 Noon and 5:00
P.M.
Pontoon boats shall not tow skiers, kneeboarders, tubers, or other
inflatable or towable devices in the ski area on Saturday, Sunday, and Holidays
between the hours of
Personal Watercraft shall not be operated in the ski
area from Memorial Day weekend through Labor Day between the hours of 12:00 Noon
and 5:00 P.M. on Saturdays, Sundays, or Holidays.
8.
THE FOLLOWING

Chapter
12.(14-15-12) Regulation of Personal Watercraft
14-15-12-1
As used in this chapter, “individual” means an individual human
being.
14-15-12-2
As used in this chapter, “person” has the meaning set forth in IC
14-8-2-202(a).
14-15-12-3
As used in this chapter, “personal watercraft” has the meaning set
forth in IC 14-8-2-202.5.
14-15-12-4
As used in this chapter, “public waters” has the meaning set forth
in IC 14-8-2-202.5.
14-15-12-5
The requirements and prohibitions set forth in this chapter concerning
personal watercraft are in addition to the requirements and prohibitions set
forth in IC
14-15-12-6
A person shall not operate a personal watercraft on public waters while
facing the rear of the personal watercraft.
14-15-12-7
A personal watercraft shall not be used on public waters to tow
individuals engaged in water-skiing, aquaplaning, or similar activities.
Unless:
(1)
the
personal watercraft is at least ten (10) feet long;
(2)
the
personal watercraft is designed to seat at least three individuals; and
(3)
an
individual other than the operator of the personal watercraft is aboard the
personal watercraft, acting as an observer.

A person shall not operate a personal watercraft on public waters unless
every individual:
(1)
operating;
(2)
riding
on; or
(3)
being
towed by; the personal watercraft is wearing a personal flotation device that is
approved by the United States Coast Guard under 46 CFR 160 and that meets the
requirements of 310 IAC 2.1, if applicable.
14-15-12-9
A personal watercraft that does not have self-circling capability shall
not be operated on public waters unless:
(1)
the
personal watercraft is equipped with a lanyard type of engine cutoff switch; and
(2)
the
lanyard is attached to the person, clothing, or personal flotation device of the
operator.
14-15-12-10
(a) A
personal watercraft operated on public waters must at all times be operated in a
reasonable and prudent manner.
(b) A person shall not operate a personal watercraft
on public waters in a way that endangers human life, human physical safety, or
property.
(c A person shall not do any of the following while
operating a personal watercraft on public water;
(1)
Weave
through congested watercraft traffic in a way that endangers human life, human
physical safety, or property.
(2)
Follow a
watercraft that is towing an individual on:
(A)
water
skis;
(B)
a surf
board; or
(C)
another
water sport device; in a way that endangers human life, human physical safety,
or property.
(3)
Jump the
wake of another watercraft in a way that endangers human life, human physical
safety, or property.
(4)
Cut
between a boat and the individual or individuals being towed by the boat.
(5)
Cross
paths with another watercraft when visibility around the other watercraft is so
obstructed as to endanger human life, human physical safety, or property.
(6)
Steer a
personal watercraft toward an object or an individual in the water and turn
sharply at close range in a way that endangers human life, human physical
safety, or property.

A person who:
(1)
owns a
personal watercraft; or
(2)
has
charge over or control of a personal watercraft; shall not authorize or
knowingly permit the personal watercraft to be operated in violation of this
chapter.
14-15-12-12 Sections
6,7,8,9, and 10 of this chapter do not apply to:
(1)
a
performer engaged in a professional exhibition; or
(2)
a person
participating in a regatta, a race, a marine parade, a tournament, or an
exhibit; that is held in compliance with rules adopted by the natural resources
commission.
14-15-12-13 (a)
A person who intentionally, knowingly, or recklessly
violates section 10 of this chapter commits a Class C
misdemeanor.
(b) A person who violates section 6,7, 8, 9, or 11 of this
chapter
commits a class C infraction

EQUIPMENT VIOLATIONS
It shall be unlawful to operate any watercraft upon
No person shall operate any boat which, or any part of which, is so
designated or constructed or is in such condition or state of repair as to
endanger the person or property of any other person.
All inboard motorboats which use motor fuel having a flash point of 110
degrees Fahrenheit or less, as determined by a taglinbue or equivalent closed
cup test device, and the greater portion of the bilge of which it is not all
times open and exposed to the air, shall be equipped with at least two (2) bilge
ventilators fitted with cowls, or their equivalent, and so designed and
constructed as to permit the safe diffusion into the air of all inflammable or
explosive gases.
On all inboard motorboats, the carburetor shall be equipped with a stock
factory device, so designed and constructed as to arrest backfire, of a make or
type approved by the U.S.C.G.
It is unlawful for any person to operate a motorboat on
It shall be unlawful to keep, maintain, or operate upon Lake Louise any
motorized watercraft of twenty (20) feet eleven (11) + inches, but not to exceed
twenty one (21) feet or more in length except for pontoon boats, which are
limited to 24’. Pontoon boats are
to be defined as boats being constructed of aluminum floatation tubes only.
Boats resembling pontoon styled decks with fiberglass hulls will have to
be 20 feet eleven + inches in length or less. This applies to deck boats.
It shall also be unlawful to keep, maintain, or operate a motorboat with
an outboard, inboard, or inboard-outdrive or jet drive of a horsepower rating in
excess of 260 H.P unless it is a fuel injected engine. These may be up to 330
H.P. These restrictions apply to all
watercraft not registered with the S.F.P.O.A. prior to
All watercraft are subject to safety/equipment inspections, measurement

watercraft, which is equipped with a water closet or toilet, unless sufficient
capacity to store wastes for subsequent disposal at approved shoreline facility,
incinerator, or treatment system approved by the Department of Environmental
Management. Holding tank must be

holding tank or any other container on a watercraft, in such a manner that the
sewage contacts any waters of
It shall be unlawful for any person to throw, dump,
place, deposit, or cause such action to happen, any litter, filth, putrid or
unwholesome substance or contents of any water closet or toilet, catch basin
grease trap, in or upon the waters or banks of Lake Louise.
It shall be unlawful to carry in any watercraft kept, maintained or
operated upon
No watercraft will have on board any device, firearm, bow, crossbows,
pellet, slingshot, or any other type of device capable of shooting a projectile
in any fashion or form.
10.
REGISTRATION
OF WATERCRAFT & TRAILER
All S.F.P.O.A. members owning a watercraft of any
type shall register the watercraft with the P.O.A.
Office and obtain an annual permit before
operating the watercraft upon the waters of
All watercraft permits granted by the S.F.P.O.A.
shall expire on December 31st of the year, except when said permit(s)
have been suspended by the S.F.P.O.A. for violations.
The registration shall include:
a)

(State & number) if applicable (located on the right rear exterior on
watercraft after 1972) and

Only those S.F.P.O.A. members in “good standing”
will be issued a registration permit and allowed to operate a watercraft on the
waters of
All watercraft must display a current S.F.P.O.A. decal on the forward
half, left (port) side of the watercraft above the water line so as to be
clearly visible for identification purposes.
All watercraft trailers must display a current S.F.P.O.A. decal on the
top portion of the hitch forward of the winch.
Those S.F.P.O.A. members trailering watercraft to the boat launch shall
park trailers in the lower clubhouse parking lot.
No boat trailers will be permitted unattended at the beach parking lot.
The Board of Directors will establish registration fees prior to each
boating season after consultation with the

ACCIDENT
PROCEDURES
S.F.P.O.A. Procedures
The operator of any watercraft involved in any
accident or collision resulting in (a) injury, (b) death, or (c) damage to any
other property shall:
(1)
Stop such
boat immediately as close as possible to the scene of such accident.
(2)
Return to
the scene of such accident and remain there until such a time both parties
involved have complied with the requirements of this section.
(3)
Give
his/her name and address, full identification of the boat operated by him or her
and the name and address of the owner and, upon request, exhibit his/her
operator’s license to the operator(s) of the other boat(s) and to any person(s)
injured.
STATE
LAWS/ACCIDENTS/VIOLATIONS
The operator of any watercraft involved in any accident or collision
resulting in a serious injury or
death to any person or damage to any watercraft or other property to an apparent
extent of Seven Hundred Fifty Dollars ($750) or more shall:
(1)
Give
notice of such accident to the officer of the Sheriff’s Department of the
County or to the nearest State Police post or to the nearest Conservation
Officer’s post immediately and by the quickest means of communication.
Failure to notify may result in prosecution.
(2) Mail to the proper authorities a written report of said accident within twenty-four (24) hours.
12.
VIOLATIONS:
FINES & PUNISHMENTS
The Board of Directors will establish violation fees
prior to each boating season after Consultation with the

Parking Violations
The continued use of a watercraft upon Lake Louise by an operator who has
had his/her boating privileges suspended may result, at the direction of the
S.F.P.O.A. Directors, with trespassing charges being filed in Porter Superior
Courts.
In the event a resident wishes to file an appeal of his/her violation,
the resident is required to file a written notice within fifteen (15) days.
This written notice should be filed in the POA office in the clubhouse
stating that a hearing is being requested. The
Grievance Committee of the POA will meet at least once a month, if needed, to
hold a hearing on any appeal. All
fines, penalties, and suspensions will start with the date of the Grievance
Committee decision.
13.
EMERGENCY CLOSURE
In case of emergency closure, the standard flagging system below may be
used to advise boat operators of the conditions then present.
The flags may be stationed at the N.E. corner of the swimming pool
closest to the lake. The flagging
system is as follows:
a) Blue flag or no flag
present
All clear
b) Yellow flag
Idle speed only/Caution
c) Red flag
Closed to all Traffic/Danger

Any resident of
any
time of the year. A resident shall
be required to show proof of residency to any peace officer of this State acting
as agents of the S.F.P.O.A. or any individuals acting as agents of the S.F.P.O.A.
upon being contacted.
