THE MORATORIUM ESTABLISHED FOR REGISTRATION OF NEW JET BOATS ON LAKE LOUISE IS STILL IN EFFECT.  NO NEW JET BOATS WILL BE REGISTERED FOR OPERATION DURING THIS PERIOD.



 

 

BOATING RULES AND REGULATIONS

 

1.      GENERAL REGULATIONS

 

The Indiana State Boating Laws are to be applicable to Lake Louise and

are to be Considered as part of the S.F.P.O.A. Boating Rules and Regulations.  The Provisions of this act shall apply to all waters of the S.F.P.O.A. and to all watercraft navigated or located thereon.  Violation of Indiana State Boating Laws shall be considered a violation of the S.F.P.O.A. Boating Rules and Regulations.  All persons who register or operate a watercraft on Lake Louise are expected to be familiar with the Indiana State Boating Laws.  Some of these boating laws are set out in these rules and regulations for convenient reference, but the fact that any law is not set out herein shall not prohibit its enforcement.

 

DOCK IDENTIFICATION (LOT NUMBERS):  The Board approved a rule requiring that all docks on Lake Louise have their lot numbers painted on them in 3” letters of a contrasting color so as to be clearly visible from the lake.  This will assist the Lake Patrol and other people involved with maintenance issues to identify docks.

 

            2.  IMPLIED CONSENT

 

            A person who registers or operates a watercraft in waters over which S.F.P.O.A. has jurisdiction implicitly consents to abide by those rules and regulations set forth in this act.

 

            3.  ENFORCEMENT

 

            All peace officers of this State acting as agents of S.F.P.O.A. shall have the power and it shall be their duty to enforce the provisions of this act and all lawful rules and regulations.

 

            4.  VIOLATIONS

 

            Violations of these rules and regulations will result in a fine being imposed upon the property owner(s) involved.  In such cases that family members or guest’s members or guests violate these rules and regulations, it shall be the responsibility of the registered owner of the watercraft involved to pay such fines.  If a violation occurs with more than one property owner in the same watercraft, it shall be the responsibility of the watercraft operator involved to pay such fines.  If the watercraft operator is a guest of the resident not owning the watercraft, the fine shall be paid by the resident hosting the guest.

 

            Nothing herein contained shall be construed to prohibit the S.F.P.O.A. or its agents from appropriate charges in the Courts of Porter County in addition to any fines herein provided for.

 

           


5.  DEFINITIONS

 

“Watercraft” means any instrumentality or device in or by means of which a person may be transported upon public or private waters of this State, and it includes every motorboat, personal watercraft, sailboat, rowboat, skiff, dinghy, or canoe of whatever length or size.

 

“Motorboat” means a watercraft propelled by an internal combustion, steam, or electrical inboard or outboard motor or engine or by any mechanical means. Sailboats that are equipped with any such motor or engine when the same is in operation, whether or not the sails are hoisted shall be considered a sailboat.

 

“Personal Watercraft” shall mean a vessel, less than 16 feet, propelled by machinery, which is designed to be operated by a person sitting, standing, or kneeling on rather than being operated by a person sitting or standing inside the vessel.

 

“Boat” means watercraft.

 

“Lake” shall mean any and every body of water connected or a part of Lake Louise .

 

“Person” means natural person, firm, partnership, association, or corporation.

 

“Owner” means a person who has legal title to a watercraft.

 

“To Operate” means the act of navigating, driving, steering, sailing, rowing, paddling, or otherwise moving or exercising physical control over the movement of the watercraft.

 

“Visible” means capable of being seen, by a person of normal vision on a dark and clear night.

 

“Sewage” means human body wastes.

 

“Litter” means bottles, glass, crockery, cans, scrap metal, junk, paper garbage, rubbish, plastic, or similar refuse.

 

“No Wake or Wash ” means at a rate of speed, notto exceed ten (10) miles per hour, whereas the watercraft does not create a substantial wake or wash.                                

                                                           

“Idle Speed” means the slowest possible speed, not exceeding five (5) miles per hour, so as to maintain steerage whereby the wake or wash created by the watercraft is minimal.

                                   

“Trespassing” means entering upon property of another without consent.

 

“Resident” means the members and associate members of the corporation (any person who both belongs to the family of a member or associate member and has the same residence as the member to whose family he belongs).

 

“Immediate Family” of a resident means grandparent, parent, children (including step and half-children), grandchildren and great grandchildren.

 

6.      SAFETY VIOLATIONS

 

“Driving Under the Influence” A person who operates a watercraft with at least five-hundredths percent (.05%) by weight of alcohol in the person’s blood may be incarcerated.

 

Violation of this act is a Class C misdemeanor.

 

A person who violated this act commits a Class D felony if:

(a)     he/she has a previous conviction under this act; or

(b)    the offense results in serious bodily injury to another person.

 

A person who violates this act commits a Class C felony if:

(a)    the offense results in the death of another person.

 

Definition of Influence can mean but is not limited to:

(a)    alcohol

(b)    controlled substance

(c)    any drug other than alcohol, or a controlled substance

(d)    any combination of alcohol, controlled substances, or other drugs; such that there is an impaired condition of thought and action and the loss of normal control of the person’s faculties to such an extent to endanger any person.

 

A person who operates a watercraft on the waters of Lake Louis implicitly consents to submit to the chemical test provisions of this act as a condition of operating the watercraft.  If a person refuses to submit to a chemical test under this act, the S.F.P.O.A. shall order the person off Lake Louise for a period of one (1) year from date of violation.

 

             “Chemical Test” means an analysis of a person’s blood, breath, urine, or other bodily substance for the determination of the presence of alcohol or a controlled substance.

 

            If the chemical test results in evidence that the person is under the influence, he/she at the discretion of the officer or the acting agents of the S.F.P.O.A. may be arrested and charges filed in Porter County Superior Courts.

 

            “Public Intoxication” It is unlawful for a person to be found in a public place or a place of public resort, in a state of intoxication.  A person who violates a provision of this section is guilty of a Class B misdemeanor.

           

“Minor’s Illegal Possession” It is unlawful for a minor to possess an alcoholic beverage, to consume it, or to transport it.  A person who violates a provision of this section is guilty of a Class C misdemeanor.

 

“Operation in Manner Endangering Others” No person shall operate any boat in such a manner as to: 

 

(1)     unnecessarily endanger the person or property of another person;

(2)     unnecessarily interfere with the safe and lawful use of the lake by another person;

(3)     unnecessarily interfere with or obstruct a special event sanctioned or otherwise legally permitted.

 

“Unlawful Operation/Speed, Manner” It shall be unlawful for any person to operate any watercraft upon Lake Louise in any manner or under any circumstances or at any rate of speed prohibited by these regulations, or for any person operating any boat upon Lake Louise to fail to operate the same in any manner required by these regulations.

 

            “Prudent (Reckless) Operation” Every person operating any boat shall operate the same in a careful and prudent manner, having due regard for the rights, safety, and property or other persons, the conditions and hazards, actual and potential, then existing, including weather and density of traffic, and possible injury to the person or property of other persons.

 

            “Speed” No person shall operate any boat at a rate of speed greater than is reasonable and prudent, having due regard for the conditions and hazards, actual and potential, then existing, including weather and density of traffic, or greater than will permit him in the exercise of reasonable care, to bring such boat to stop within the assured clear distance ahead.  Maximum speed limit is forty (40) miles per hour between 8:00A.M. and sunset or when hereinafter not regulated.

                                                                       

“Speed/Night” Between sunset and 8:00 A.M. the waters of Lake Louise are to be considered “Idle Speed” only.  It shall also be unlawful to tow an object with a boat, except a disabled motor boat.

 

            “Life Preservers” "Life Preservers" The S.F.P.O.A. requires one wearable lifejacket, Coast Guard approved type 1, 2, or 3 per person in any boat operated on waters of Lake LouiseThis is for all boats. In addition, one (1) Coast Guard approved Type 4 throwable life preserver is required in all boats 16' and over and with a 10 horsepower motor or greater.

 

            In addition to the above, the following applies to all motor boats on waters of Lake Louise .

 

            (312 IAC 5-13-1):      

 

·        Children under 13 years of age must wear a PFD except when the child is below deck in an enclosed cabin, or the watercraft is docked or at anchor.

 

·        Anyone towed on water skis , a surfboard, a kite or similar device, must wear a Type I, II or III PFD. (Type V PFDs are not approved)

 

            “Night Operations/Lights” It shall be unlawful to operate any watercraft upon Lake Louise during the period between sunset and sunrise which is not equipped with a light or lights as hereinafter required, all in good repair and operating condition and all displayed and lighted or burning except as hereinafter otherwise permitted.

 

            “Motorboats and Auxiliary Sailboats/White Light Aft” All motorboats and auxiliary sailboats shall be equipped with one (1) or more white lights aft, visible at all times casting a combined light three hundred and sixty (360) degrees for a distance of two (2) miles or more.

                                                           

            “Motorboats and Auxiliary Sailboats/Starboard and Port Lights” All motorboats and auxiliary sailboats equipped with a motor or engine at fifteen (15) horsepower or more shall be equipped with a combination light forward, lower than the white light aft, showing green to starboard and red to port, visible for a distance of one (1) mile or more.  All lights shall be displayed at all times between sunset and sunrise; however, the aft lights only may be displayed if said watercraft is not under power.

 

            “All Other Watercraft” All non-motorized boats (including canoes and kayaks), all sailboats under sail alone, all boats not specifically mentioned in this section and the preceding two (2) sections shall be equipped with a portable hand lantern or flashlight, not affixed or attached to any part of the boat, and capable of throwing a white light visible for a distance of two (2) miles or more, and it shall be the duty of the operator of any such boat to display the white light at all times between sunset and sunrise.

 

            “Fire Extinguisher” All Motorboats shall be equipped with at least one (1) operable extinguisher that is U.S.C.G. approved. 

 

            “Age of Operators-Motorboats” It shall be unlawful for any person under the age of sixteen (16) years of age, and who does not possess a valid State driver’s license to operate a watercraft with a horsepower rating in excess of ten (10) horsepower except under the following condition:

 

(a)    Such person under the age of sixteen (16) years, possesses a valid State probationary driver’s license and is accompanied by a person who possesses a valid State driver’s license and has attained the age of 18 years or older.

 

“Age of Operators-Personal Watercraft” It shall be unlawful for any person under the

 Person under the age of eighteen (18) years, and who does not possess a valid State driver’s license to operate a personal watercraft on Lake Louise .

 

            “Jurisdiction for Prosecution-persons between ages of 16 and 18 years old” Any person between the ages of sixteen (16) and eighteen (18) who violates any of the provisions of this chapter may be prosecuted and tried in any court having jurisdiction over adult.

 

            “Load beyond safe carrying capacity” No person shall operate any boat, which is loaded with passengers or cargo beyond its safe carrying capacity.  The capacity of the watercraft will be based on the U.S.C.G. carrying capacity plate when available or in regard for the type, construction, and condition or state or repair of said watercraft when U.S.C.G. carrying capacity plate is not available.

 

7.      OPERATION OF WATERCRAFT

 

Guest Rule” All operators of watercraft, powered by people, wind, or motor, less than 10 hp must be accompanied by a member of the immediate family of the property owner.  For purposes of this Section, Immediate Family Members of a Resident shall be limited to:  Grandparents, Parents, Children (including Step and Half Children), Grandchildren and Great-Grandchildren. 

 

All operators of motorboats 10 hp or greater (not residents or property owners) must be accompanied by a property owner or resident.  The age of the resident accompanying a guest shall be a minimum of 16 years old and be in possession of a valid driver’s license and be familiar with Shorewood Forest Lake Rules.  

           

“Permitting Unlawful Operation” No person who is the owner of any boat or who is in possession of any boat or who is entitled to the possession of any boat shall authorize or knowingly permit any person to operate said boat upon the waters of Lake Louise in violation of any provisions of this act.

 

            “Hazardous Wake or Wash ” No person shall operate any motor boat so as to approach another boat in such a manner or at such a rate of speed as to create a hazardous wake or wash.

 

                                                            TRAFFIC RULES

 

            Every person operating any boat shall observe the following traffic rules and regulations when applicable:

 

(a)    When two boats are approaching each other “head to head” or nearly so, each boat shall bear to the right (starboard) and pass the other boat on its left (port) side.

(b)    When two (2) motorboats are approaching each other obliquely or at right angles, the motorboat on the right (starboard) shall have the right-of-way.

(c)    A boat may overtake and pass another boat on either side if the same can be done with safety and within the assured clear distance ahead, but the boat overtaken shall have the right-of-way regardless of speed or direction of travel.

(d)    All motorboats shall at all times give the right-of-way to all other non-motorized watercraft regardless of speed or direction of travel regardless if non-motorized watercraft is committing a violation.

(e)    A motorboat leaving a dock, pier or shore shall yield the right-of-way to all motorboats approaching the same.

(f)      A motorboat entering the ski-area shall yield the right-of-way to all approaching motorboats.

 

The S.F.P.O.A. Board of Directors will establish “No Wake” or “Idle Speed” areas for safety purposes and to help reduce erosion.  The lake will be designated “Idle Speed” only after sunset to 8:00 A.M.

 

            No person shall operate any boat in a circular course around any other boat, any occupant of which is engaged in fishing, or around which a person or persons are swimming.

 

            No person shall anchor a motorboat, or have any non-motorized watercraft in the designated ski area between the hours of 8:00 A.M. to sunset.  No boat shall be allowed to float free in the ski area unless preparing for skiing or other related activities. No person may fish in the ski area and surrounding safety zone from a watercraft during the times from 8:00 AM to sunset from Memorial Day weekend through Labor Day.

 

            No person operating or occupying any boat shall sound any whistle or horn when the passage of such boat is clear and without danger or when a warning signal is not necessary to prevent injury to person or property.  Unnecessary sounding of a whistle or horn is hereby declared to be a public nuisance and is hereby prohibited.

 

            No person operating any motorboat shall permit any occupant to sit, stand, or lie on the gunwales, bow decking, or transom while under power.

 

            No person shall participate or compete in any boat race unless such race is over a fixed and marked course and unless the S.F.P.O.A. Board of Directors has duly issued a permit for such race.

 

            No person shall attach any boat to any buoy or markers on Lake Louise .

 

            No person shall moor any boat to anything other than approved docks or against the bank of the property owner’s residence.  Ring buoy-type offshore mooring is prohibited.

 

            No person shall operate a watercraft within thirty (30) feet of the shoreline or within thirty (30) feet of a dock at a speed greater than “Idle Speed” only.

 

            No person shall operate a watercraft within one hundred (100) feet of the swimming zone or docking areas at a speed greater than “Idle Speed” only.

 

“SWIMMING, SKIING, AND RELATED WATER SPORTS”

 

            No swimming or floating on flotation devices will be permitted in the designated ski area.

 

            No scuba diving will be permitted in the designated ski area without first securing a permit from the S.F.P.O.A. Board of Directors and having the proper visual flagging while diving.

 

            All provisions of these regulations with respect to the operation of watercraft shall apply whether or not such watercraft is towing any person or article.

 

            No person shall operate any motorboat towing any water skier, water sled, aquaplane, or similar object, or any person thereon, unless said motorboat is occupied by at least one person who is giving his entire attention to watching the object or person towed, and unless the person operating said boat is giving his entire attention to the operation of said boat. The minimum age of Spotters shall be of a responsible age.

                                                           

            Regardless of the capacity of the inflatable device, no person shall operate any motorboat towing any inflatable with more than one occupant at a time in the ski area.

 

            Every person operating any boat in the designated ski/caution area shall operate it in a counter-clockwise direction.

           

No person shall jump or dive from the bridge.

 

            No person shall operate any motorboat towing a water skier, or person on an aquaplane, tube, or similar object after sunset to 8:00 A.M.

 

            No person shall operate any motorboat in the ski area that is towing a device that is occupied by more than one person.

 

            No skier is permitted to start from a dock, pier, or roped swimming area.

 

            If a skier falls, he/she shall retrieve skis and raise one of the same high, so as to be more visible to other watercraft.  All watercraft shall stay at least one hundred (100) feet from any person in the water.

 

            When a skier or tuber, etc. has fallen, boat operator is to throttle back and return to skier as soon as possible, never enlarging the distance between boat and skier.  The observer is to raise an orange flag large enough to be visible 200 feet and high enough to be seen 360 degrees over any portion of the boat when the skier or tuber, etc. has fallen.  The observer will continue to raise the flag until the skier or tuber, etc. has resumed skiing/tubing or upon boarding the boat and is out of the water.

 

            Tow ropes shall be pulled in immediately after use, and watercraft shall not operate in any portion of Lake Louise with said lines extended unless same are in use.

 

            No watercraft shall travel directly behind another watercraft towing a skier, tuber, or passenger on any similar devices at a distance closer than two hundred (200) feet.

 

            Tandem devices or devices with more than one occupant may be towed at idle speed only in the idle speed areas of the lake at any time between the hours of 8:00 A.M. and sunset.

 

            No tandem skiing, tandem tubing, tandem knee boarding, etc. in the ski area on Saturday, Sunday, and Holidays between the hours of 12:00 Noon and 5:00 P.M.

 

            Pontoon boats shall not tow skiers, kneeboarders, tubers, or other inflatable or towable devices in the ski area on Saturday, Sunday, and Holidays between the hours of 12:00 Noon and 5:00 P.M.

           

Personal Watercraft shall not be operated in the ski area from Memorial Day weekend through Labor Day between the hours of 12:00 Noon and 5:00 P.M. on Saturdays, Sundays, or Holidays.

 

To participate in the water sport of wake surfing/wake boarding on Lake Louise , the following regulations shall be adhered to.

 

Wake Surfing/Wake Boarding shall only be done behind an inboard or “V” Drive propelled watercraft. (The propeller(s) is underneath the hull and forward of the stern).

 

There must be an observer on the watercraft of responsible age giving his/her full attention to the Wake Surfer/Wake Boarder in addition to the operator of the watercraft. The observer is to raise an orange flag large enough to be visible at 200 feet and high enough to be seen 360 degrees over any portion of the boat when the skier or tuber, etc, has fallen.  The observer will continue to raise the flag until the skier or tuber, etc. has resumed skiing/tubing, etc. or upon boarding the boat and is out of the water.

 

The Wake Surfer/Wake Boarder must be wearing a USCG Approved type 1, 2, or 3 Personal Flotation Device while Wake Surfing/Wake Boarding.

 

No more than One (1) Person can Wake Surf/Wake Board in the wake of any one watercraft at a given time.

 

All other General Boating and Water Sports Related Shorewood Forest Property Owner Association Rules including but not limited to an observer on the watercraft of responsible age giving his/her full attention to the Wake Surfer/Wake Boarder shall apply.  The observer is to raise an orange flag large enough to be visible at 200 feet and high enough to be seen 360 degrees over any portion of the boat when the skier or tuber, etc. has fallen.  The observer will continue to raise the flag until the skier or tuber, etc. has resumed skiing/tubing, etc. or upon boarding the boat and is out of the water.

                                                           

8.  THE FOLLOWING INDIANA STATE RULES HAVE BEEN

            ADOPTED FOR PERSONAL WATERCRAFT ON LAKE LOUISE :

 

SECTION 9.1C 14-15-12 IS ADDED TO THE INDIANA CODE AS A NEW CHAPTER TO READ AS FOLLOWS:

 

            Chapter 12. (14-15-12) Regulation of Personal Watercraft

 

14-15-12-1     As used in this chapter, “individual” means an individual human being.

14-15-12-2     As used in this chapter, “person” has the meaning set forth in IC 14-8-2-202(a).

14-15-12-3     As used in this chapter, “personal watercraft” has the meaning set forth in IC 14-8-2-202.5.

14-15-12-4     As used in this chapter, “public waters” has the meaning set forth in IC 14-8-2-202.5.

14-15-12-5     The requirements and prohibitions set forth in this chapter concerning personal watercraft are in addition to the requirements and prohibitions set forth in IC 14-5-3 and IC 14-15-8.

14-15-12-6     A person shall not operate a personal watercraft on public waters while facing the rear of the personal watercraft.

14-15-12-7     A personal watercraft shall not be used on public waters to tow individuals engaged in water-skiing, aquaplaning, or similar activities.  Unless:

(1)    the personal watercraft is at least ten (10) feet long;

(2)    the personal watercraft is designed to seat at least three individuals; and

(3)    An individual other than the operator of the personal watercraft is aboard the personal watercraft, acting as an observer.

14-15-12-8     A person shall not operate a personal watercraft on public waters unless every individual:

(1)    operating;

(2)    riding on; or

(3)    being towed by; the personal watercraft is wearing a personal flotation device that is approved by the United States Coast Guard under 46 CFR 160 and that meets the requirements of 310 IAC 2.1, if applicable.

14-15-12-9     A personal watercraft that does not have self-circling capability shall not be operated on public waters unless:

(1)    the personal watercraft is equipped with a lanyard type of engine cutoff switch; and

(2)    The lanyard is attached to the person, clothing, or personal flotation device of the operator.

14-15-12-10 (a) A personal watercraft operated on public waters must at all times be operated in a reasonable and prudent manner. 

(b) A person shall not operate a personal watercraft on public waters in a way that endangers human life, human physical safety, or property.

(c A person shall not do any of the following while operating a personal watercraft on public water;

(1)   Weave through congested watercraft traffic in a way that endangers human life, human physical safety, or property.

(2)   Follow a watercraft that is towing an individual on:

(A)   water skis;

(B)   a surf board; or

(C)   Another water sport device; in a way that endangers human life, human physical safety, or property.

(3)   Jump the wake of another watercraft in a way that endangers human life, human physical safety, or property.

(4)   Cut between a boat and the individual or individuals being towed by the boat.

(5)   Cross paths with another watercraft when visibility around the other watercraft is so obstructed as to endanger human life, human physical safety, or property.

(6)   Steer a personal watercraft toward an object or an individual in the water and turn sharply at close range in a way that endangers human life, human physical safety, or property.

14-15-12-11 A person who:

(1)   owns a personal watercraft; or

(2)   has charge over or control of a personal watercraft; shall not authorize or knowingly permit the personal watercraft to be operated in violation of this chapter.

14-15-12-12 Sections 6,7,8,9 and 10 of this chapter do not apply to:

(1)    a performer engaged in a professional exhibition; or

(2)    a person participating in a regatta, a race, a marine parade, a tournament, or an exhibit; that is held in compliance with rules adopted by the natural resources commission.

14-15-12-13 (a) A person who intentionally, knowingly, or recklessly

                          violates section 10 of this chapter commits a Class C

                          misdemeanor.

                     (b) A person who violates section 6, 7, 8, 9, or 11 of this

                           chapter commits a class C infraction

14-15-12-14  The natural resources commission may adopt rules under

                                  IC 4-22-2 to implement this chapter.

 

 

9.   EQUIPMENT VIOLATIONS

 

            It shall be unlawful to operate any watercraft upon Lake Louise which is not equipped with the equipment listed in this section, all in good repair and operating condition and ready for use at all times.

 

            No person shall operate any boat which, or any part of which, is so designated or constructed or is in such condition or state of repair as to endanger the person or property of any other person.

 

            All inboard motorboats which use motor fuel having a flash point of 110 degrees Fahrenheit or less, as determined by a taglinbue or equivalent closed cup test device, and the greater portion of the bilge of which it is not all times open and exposed to the air, shall be equipped with at least two (2) bilge ventilators fitted with cowls, or their equivalent, and so designed and constructed as to permit the safe diffusion into the air of all inflammable or explosive gases.

 

            On all inboard motorboats, the carburetor shall be equipped with a stock factory device, so designed and constructed as to arrest backfire, of a make or type approved by the U.S.C.G.

 

            It is unlawful for any person to operate a motorboat on Lake Louise unless said boat motor is equipped with a muffler, underwater exhaust or other device, which muffles or suppresses the sound of the exhaust so as to prevent excessive and unusual noise at all speeds.

                                                           

            It shall be unlawful to keep, maintain, or operate upon Lake Louise any motorized watercraft of twenty (20) feet eleven (11) + inches, but not to exceed twenty one (21) feet or more in length except for pontoon boats, which are limited to 24’.  Pontoon boats are to be defined as boats being constructed of aluminum floatation tubes only.  Boats resembling pontoon styled decks with fiberglass hulls will have to be 20 feet eleven + inches in length or less. This applies to deck boats.  It shall also be unlawful to keep, maintain, or operate a motorboat with an outboard, inboard, or inboard-outdrive or jet drive of a horsepower rating in excess of 260 H.P unless it is a fuel injected engine. These may be up to 330 H.P.  These restrictions apply to all watercraft not registered with the S.F.P.O.A. prior to August 1, 1985 .  Watercraft currently owned over twenty (20) feet will be “grandfathered” ONLY if the watercraft was registered in 1994.  Pontoon boats over 24’ that were registered in 1998, will be “grandfathered”.

 

            All watercraft are subject to safety/equipment inspections, measurement of center line length and horsepower verification by Lake Patrol officers employed by the Shorewood Forest Property Owners’ Association, Inc.  Any watercraft being over limit in length or horsepower will be removed from the waters of Lake Louise immediately by the owner.  Safety/Equipment violations will be fined as outlined in section #11.       


Class #1  means all watercraft less than thirteen (13) feet in length.

            Class #2  means all watercraft at least thirteen (13) feet but less than

            sixteen (16) feet in length.      

            Class #3  means all watercraft at least sixteen (16) feet but less than

            twenty (20) feet in length. 

            Class #4  means all watercraft at least twenty (20) feet but less than

            twenty-six (26) feet in length.

 

            It shall be unlawful to keep, maintain, or operate upon Lake Louise any watercraft, which is equipped with a water closet or toilet, unless sufficient capacity to store wastes for subsequent disposal at approved shoreline facility, incinerator, or treatment system approved by the Department of Environmental Management.  Holding tank must be incapable of direct discharge into Lake Louise .

           

No person shall dispose of sewage, accumulated in a holding tank or any other container on a watercraft, in such a manner that the sewage contacts any waters of Lake Louise .

           

It shall be unlawful for any person to throw, dump, place, deposit, or cause such action to happen, any litter, filth, putrid or unwholesome substance or contents of any water closet or toilet, catch basin grease trap, in or upon the waters or banks of Lake Louise.

 

            It shall be unlawful to carry in any watercraft kept, maintained or operated upon Lake Louise , any gas, liquefied gas, inflammable liquid or other certified hazardous materials/wastes listed by the Department of Transportation.  Exemptions are limited to motor fuel or fuel used in pocket cigarette, cigar, or pipe lighters.

 

            No watercraft will have on board any device, firearm, bow, crossbows, pellet, slingshot, or any other type of device capable of shooting a projectile in any fashion or form.

 

10.    REGISTRATION OF WATERCRAFT & TRAILER

 

All S.F.P.O.A. members owning a watercraft of any type shall register the watercraft with the P.O.A.  Office and obtain an annual permit before operating the watercraft upon the waters of Lake Louise .

 

All watercraft permits granted by the S.F.P.O.A. shall expire on December 31st of the year, except when said permit(s) have been suspended by the S.F.P.O.A. for violations.  The registration shall include:

 

To avoid unnecessary delays in registering your boat, please take a few minutes to review this information regarding boat registration.


 

1.                  All watercraft on Lake Louise must be registered and display a current SFPOA boating decal.  Only residents whose assessments are current, and have no outstanding lake fines, will be allowed to register a boat.  NOTE:  There is a moratorium not allowing new jetboats to be registered on Lake Louise .

 

2.                  Before any motorized boat may be registered, the owner must show proof of liability insurance coverage on the boat.  This rule will be strictly enforced –NO EXCEPTIONS.  Even if the boat has been registered in the past, this proof must be shown each year.  Insurance must be in the form of either a declarations page or certificate of insurance providing the following information:  Boat manufacturer’s name, Hull identification number, Motor manufacturer’s name, Motor serial number, Length and Horsepower of boat.  Non-motorized boats require proof of homeowner’s insurance showing effective date.

 

3.                  Guest boats are not permitted.  Any property owner, who falsely registers a boat to obtain a sticker for someone not entitled to one, may forfeit his boating privileges.

 

4.                  Prior to registering a boat, all residents who have not taken the State or Coast Guard certified boating-safety course, must pass a 25-question test based on Lake Louise rules.

 

5.                  Boats over 260 HP are not permitted on Lake Louise .  (Fuel injected inboard engines up to 330 hp are the only exceptions to this rule.)  Boats (except pontoons) may not be longer than 20’11”.  This clarifies the length registration to coincide with the registration process of the Bureau of Motor Vehicles and the Department of Natural Resources.  Pontoons may not be longer than 24’.

 

In order to expedite the registration of your boat, please bring the following information:

 

·        PROOF OF INSURANCE – Either a declaration page or certificate of insurance.

 

·        INFORMATION DESCRIBING BOAT & MOTOR - manufacturer, type, year, HIN number, length, horsepower, and serial number for motor.

 

·        PROOF OF OWNERSHIP – When registering your boat for the first time, you must provide a Certificate of Origin or title, and Bill of Sale showing the information described above.  Thereafter, your insurance information will indicate continued ownership.

 

·        EXCISE TAX – As of July 1st, it will be required that every boat owner have an excise tax sticker affixed to their boat. At the time of registration at Shorewood, a copy of the current state registration will be required.

 

Only those S.F.P.O.A. members in “good standing” will be issued a registration permit and allowed to operate a watercraft on the waters of Lake Louise .  All watercraft upon the waters of Lake Louise without proper registration will be considered TRESSPASSING and may at the discretion of the S.F.P.O.A. Board have charges filed against the operator in Porter County Superior Courts.

 

            All watercraft must display a current S.F.P.O.A. decal on the forward half, left (port) side of the watercraft above the water line so as to be clearly visible for identification purposes.  All watercraft trailers must display a current S.F.P.O.A. decal on the left side of the hitch forward of the winch.

 

            Those S.F.P.O.A. members trailering watercraft to the boat launch shall park trailers in the lower clubhouse parking lot.  No boat trailers will be permitted unattended at the beach parking lot.

 

            The Board of Directors will establish registration fees prior to each boating season.

 

11.    ACCIDENT PROCEDURES

 

S.F.P.O.A. Procedures

 

The operator of any watercraft involved in any accident or collision resulting in (a) injury, (b) death, or (c) damage to any other property shall:

           

(1)    Stop such boat immediately as close as possible to the scene of such accident.

(2)    Return to the scene of such accident and remain there until such a time both parties involved have complied with the requirements of this section.

(3)    Give his/her name and address, full identification of the boat operated by him or her and the name and address of the owner and, upon request, exhibit his/her operator’s license to the operator(s) of the other boat(s) and to any person(s) injured.

 

STATE LAWS/ACCIDENTS/VIOLATIONS

 

            The operator of any watercraft involved in any accident or collision resulting in a serious injury or death to any person or damage to any watercraft or other property to an apparent extent of Seven Hundred Fifty Dollars ($750) or more shall:

 

(1)    Give notice of such accident to the officer of the Sheriff’s Department of the County or to the nearest State Police post or to the nearest Conservation Officer’s post immediately and by the quickest means of communication.  Failure to notify may result in prosecution.

(2)      Mail to the proper authorities a written report of said accident within twenty-four (24) hours.


 

12.    VIOLATIONS:  FINES & PUNISHMENTS

 

The Board of Directors will establish violation fees prior to each boating season.

            Violations to these rules and regulations will result in a fine being imposed to the property owner(s) involved.  In such cases where family members or guests are found in violation of these rules and regulations, it shall be the responsibility of the registered owner of the boat(s) involved to make certain such fines are paid.  Fines will be paid to the S.F.P.O.A. and will be assessed as follows.

 

            The following constitutes the maximum violations a person can receive in a 365-day period before losing their rights and privileges to operate a watercraft upon Lake Louise .  In such cases, that family members or guests violate these rules and regulations, it shall be the responsibility of the registered owner of the watercraft involved to pay such fines and loss of boating privileges.

 

#1.       One of Type One, Type Two, or Type Three violations

            #2.       Two Type Four Violations and one violation of any other lesser type

            #3.       Three Type Five Violations and one violation of any other lesser type

            The continued use of a watercraft upon Lake Louise by an operator who has had his/her boating privileges suspended may result, at the direction of the S.F.P.O.A. Directors, with trespassing charges being filed in Porter Superior Courts.

 

APPEAL PROCESS

 

            In the event a resident wishes to file an appeal of his/her violation, the resident is required to file a written notice within fifteen (15) days.  This written notice should be filed in the POA office in the clubhouse stating that a hearing is being requested.  The Grievance Committee of the POA will meet at least once a month, if needed, to hold a hearing on any appeal.  All fines, penalties, and suspensions will start with the date of the Grievance Committee decision.

 

            13.  EMERGENCY CLOSURE

 

            In case of emergency closure, the standard flagging system below may be used to advise boat operators of the conditions then present.

 

            The flags may be stationed at the N.E. corner of the swimming pool closest to the lake.  The flagging system is as follows:

 

            a)  Blue flag or no flag present               All clear

            b)  Yellow flag                                      Idle speed only/Caution

            c)  Red flag                                                       Closed to all Traffic/Danger

 

B.  FISHING RULES AND REGULATIONS

 

1.      GENERAL PERMISSION

 

Any resident of Shorewood Forest may fish the waters of Lake Louise at

any time of the year.  A resident shall be required to show proof of residency to any peace officer of this State acting as agents of the S.F.P.O.A. or any individuals acting as agents of the S.F.P.O.A. upon being contacted.

 

            Any guests of Shorewood Forest residents, may fish the waters of Lake Louise at any time of year while accompanied by the Shorewood Forest resident.  Those guests not accompanied by a resident may face criminal prosecution as well as the Shorewood resident who allows them to do so.

 

            Any resident who owns lakefront property may allow a guest to fish from that property or dock as long as a registered family member is home.

 

            A Shorewood Resident shall have no more than eight (8) Non-resident Guests while ice-fishing with no more than three (3) ice shanties per group.  All non-resident guest fishermen must remain in visual contact of where the resident host is fishing.

 

2.      EQUIPMENT VIOLATIONS

 

It is lawful to take fish with not more than three poles or hand lines at any

one time.  Not more than two single hooks or two artificial baits or harnesses for use with live bait may be used on each line.

 

            It is unlawful to take or attempt to take any fish from waters of Lake Louise by means of hook or hooks, baited or unbaited, dragged or jerked through the water with intent to snag fish on contact.

 

            It is unlawful to possess a fish spear, gig, gaff, pitchfork, bow fishing equipment, bow, crossbow, grab hook, spear gun, club, snag hook, underwater spear or explosive on waters of Lake Louise .

 

            Float (jug) fishing, trout lines and limb or drop lines are not allowed on Lake Louise .

 

            Ice fishing holes cannot be more than twelve (12) inches in diameter.  It is illegal to fish with more than three lines.  Each line shall not have more than two single hooks or two artificial baits per line.  Tip-ups must be identified with the name and address of the user.  All tip-ups shall be in constant attendance by the person fishing them.  Ice shanties are required to have the owner’s name and address in 3-inch block letters on the side of the shanty.  At least one red reflector shall be mounted on each exterior side of the shanty.  All ice shanties must be occupied at all times and any shanty left unoccupied for more than a four (4) hour period must be removed from Lake Louise .

 

3.      FISHING LIMITS

 

It shall be unlawful to keep any bass or muskie of any size caught from Lake Louise .  

It is also unlawful to keep more than 25 crappies.  Any peace officer of the State acting as agent of the S.F.P.O.A. shall have the authority to open and visually inspect any fish stringers and/or the interior of any live wells and/or coolers for fish of any individuals, residents of Shorewood Forest, or their guests, who are exercising their privilege of fishing the waters of Lake Louise pursuant to Section 12(B)(1) of these Boating Rules.  Please do not return any Bluegill to the lake.

                                                           

C.  HUNTING RULES AND REGULATIONS

 

            It shall be unlawful to hunt, pursue, or take any domestic or wild animal by any means within the boundaries of the Shorewood Forest Properties.  No resident shall discharge any firearm, bow, crossbow, pellet, slingshot, or any other type device capable of shooting a projectile in any fashion or form.

                                                           

            Contacting Shorewood Forest Property Owners’ Association may control nuisance animals (those animals requiring a permit from the Department of Natural Resources to catch or destroy).

           

            Contact the POA Office if you are having a nuisance animal problem.

 

D.  TRAPPING RULES AND REGULATIONS

 

It shall be unlawful to trap, pursue, or take any domestic or wild animal by

any means, whether above or below water line, within the boundaries of the Shorewood Forest Properties.

 

            Contacting the Shorewood Forest Property Owners’ Association may control nuisance animals (those animals requiring a permit from the Department of Natural Resources to catch or destroy).

 

            Contact the POA Office if you are having a nuisance animal problem.

 

E.  SNOWMOBILE RULES AND REGULATIONS

 

It shall be unlawful to operate a snowmobile on the County road system or

upon the frozen waters of Lake Louise .

 

            No snowmobile is to be operated on private property without the expressed permission of the property owner.  Snowmobile operators on private property without permission will be subject to trespassing charges.

 

F.  OFF-ROAD VEHICLE RULES AND REGULATIONS

 

Porter County ordinances state that it is unlawful to operate any off-road

vehicles on the county road system.  Off-road vehicles/or any motorized vehicle may not be operated upon the frozen waters of Lake Louise .

 

            No off-road vehicle is to be operated on private property without the expressed permission of the property owner.

 

            Off-road operators on private property without permission will be subject to trespassing charges.

                                                           

G.  REVISION PROCEDURES

 

Any member in good standing of the Shorewood Forest Property Owners’

Association may propose revisions or amendments to these rules at the monthly P.O.A. Board meeting.  Proposed changes must be submitted in writing.

                                   

            Following any monthly board meeting in which revisions are proposed, S.F.P.O.A. board will instruct the Lake Rules/Management Committee to meet and consider the proposed changes.

 

            The Lake Rules/Management Committee, in consultation with a law enforcement official, will consider all proposed revisions and recommend changes to the S.F.P.O.A. Board.

 

            Proposed changes will be published in the Shorelines for one month before the board votes to accept or reject the changes proposed by the Lake Rules/Management Committee.  P.O.A. Board meetings following publication of the proposed changes will set aside a period of time to receive comments from the community regarding the effect of the proposed changes.

 

            Following the period of public comment, the rules may be modified to reflect public comments.  The final revised rules will be published as final in the Shorelines and will go into effect on the first day of the following month.

 

                The foregoing not withstanding, the Board of Directors retains its inherent authority to change or modify these rules, regulations and procedures at its discretion.
